IMPORTANT ANNOUNCEMENT FOR SUBCLASS MEMBERS – Updated 12/21/2007

If you would like to donate your Subclass award (“Voucher”), please indicate to which of these following charities, agreed upon by the Parties, that you would like to donate your replacement phone award. If you have not redeemed your Voucher and would like to donate your replacement phone to one of the charities listed above, complete the Redemption section of your Voucher in full and write the charity on the Transferee Print Name line located in the Transfer section. Vouchers are valid for ninety (90) from the date it is issued. Please send the completed Voucher to the Claims Administrator, c/o Rust Consulting, Inc., P.O. Box 127, Minneapolis, MN 55440-0127. The Defendants will donate that phone directly to the charity on your behalf.

If you have already redeemed your Voucher and submitted it to the Claims Administrator, but would like to donate it to one of the listed charities, you can follow the instructions outlined on the Cell Phones for Soldiers and Dial-a-Life websites when you receive your replacement phone from the Defendant.

If you have made a claim under one of Asurion or lock\line’s
Wireless Phone Protection Programs, then
you may be entitled to benefits from a Proposed Class Action Settlement.

A proposed Settlement has been reached in a class action, Perez, et al. v. Asurion Corp., et al., Case No. 06-20734-Civ-Seitz/McAliley, about the “Wireless Phone Protection Programs” offered by Asurion Corporation, Asurion Insurance Services, Inc., Asurion Florida Warranty Services, Inc., lock\line LLC and lock\line Warranty Services of Florida LLC (collectively, the “Defendants”) and their affiliated companies.

In the lawsuit, the Plaintiffs allege that the Defendants misrepresented and failed to adequately disclose the terms of their “Wireless Phone Protection Programs.” Plaintiffs further claim that the Defendants failed to properly perform their legal and contractual obligations under the programs, and, at times, provided replacement equipment that was worth less than the deductible and was not of like kind and quality.

Final Fairness Hearing The Court shall hold a Final Fairness Hearing to determine: (a) whether the proposed Settlement of this class action, on the terms and conditions provided for in the Settlement Agreement, is fair, adequate and reasonable as to the Class Members and should be approved by the Court; (b) whether a Final Settlement Order and Judgment, as provided for in the Settlement Agreement, should be entered; and (c) the amount of fees and expenses to be awarded to Class Counsel and the amount of the incentive awards to be paid to the Class Representatives. June 22, 2007
